Spain’s RITE regulation requires non-residential buildings with heating or cooling systems above 290 kW of effective rated output to have a building automation and control system, where technically and economically feasible. The system must log and analyse consumption, detect efficiency losses and communicate with the building’s systems. The 2024 EU directive lowers the threshold to 70 kW by the end of 2029.
What exactly do the rules say?
The obligation is in technical instruction IT 1.2.4.3.5 of Spain’s Regulation on Thermal Installations in Buildings (RITE), introduced by Real Decreto 178/2021. It applies to non-residential buildings with an effective rated output above 290 kW for heating, cooling or systems combined with ventilation.
The condition is that it be technically and economically feasible. This is not an automatic exemption: if no system is installed, you should be able to justify why.
What must the system be able to do?
A programmable thermostat on each floor does not meet these functions. Nor does a system that controls but neither logs nor alerts.

What changes with the 2024 EU directive?
- Directive (EU) 2024/1275 keeps the 290 kW threshold, with a deadline of 31 December 2024.
- It adds a second threshold: non-residential buildings above 70 kW must be equipped by 31 December 2029.
- It adds a function: monitoring of indoor environmental quality.
- Spain must bring these changes into its own rules; it is worth taking them into account in any refurbishment designed now.
How do I know whether my building is affected?
This guide is for information. For a specific case, the reference is the text of the RITE and the judgement of the competent engineer.
- Add up the effective rated output of the heating generators, or of the cooling generators, shown in the design or in the certificate of the thermal installation.
- If it exceeds 290 kW, the obligation already applies. If it is between 70 and 290 kW, it will apply in the coming years.
- Check what the current system does: if it controls but does not log, analyse or alert, it does not comply.
- Ask your maintenance contractor or an integrator for a report on what is missing and its feasibility.
